Terms of service

Article 1 (General)

These Terms of Service (the “Terms”) set out the conditions for using the online shop service (the “Service”) provided by the ISAMI online shop (the “Shop”). By using the Service, you are deemed to have agreed to these Terms.

Article 2 (Definition of user)

“User” means any person who uses the Service.

Article 3 (Accounts)

1. Users shall create an account using accurate information.
2. Users are responsible for managing their account details (ID, password and similar). The Shop accepts no liability for loss arising from unauthorised use by a third party.
3. If a User breaches these Terms, the Shop may suspend or delete the account without prior notice.

Article 4 (Orders and formation of contract)

1. Users order products through the Shop's website.
2. The contract of sale is formed when the Shop sends the User an email confirming that the order has been dispatched.
3. The price of a product is the amount displayed when the order is confirmed. The User shall pay by the designated payment method.

Article 5 (Delivery)

1. Products are delivered by the designated shipping method. Dispatch is normally within 7 business days of order confirmation.
2. Shipping is charged at the rates the Shop sets out separately in the Shipping Policy and on the Shipping page. Shipping is free where the conditions set by the Shop are met (merchandise subtotal at or above a set amount).
3. Where delivery is delayed by natural disaster, traffic conditions, stock shortage or other unavoidable causes, the Shop is not liable for loss arising from the delay.

Article 6 (Cancellation, returns and exchanges)

1. Cancellation: orders can be cancelled only before the Shop arranges shipment. Cancellation after shipment has been arranged is generally not possible.
2. Returns and exchanges: the tabi sold by the Shop are worn directly against the skin and are treated as hygiene products. We cannot accept returns or exchanges for customer reasons, such as wrong size or not as expected, regardless of the condition of the item.
3. Faulty or incorrect items: only in the case of a manufacturing defect (loose threads, damage and similar) or an incorrect item, and on contact within 7 days of delivery, we will exchange or refund the item and cover the shipping.

Article 7 (Intellectual property)

Intellectual property rights in all images, text, logos and other content published on the Shop's website belong to the Shop or its licensors. Reproduction or reuse without permission is prohibited.

Article 8 (Prohibited conduct)

Users shall not, in using the Service:

1. act in breach of law or public order and morals;
2. infringe the rights or interests of the Shop, other Users or third parties;
3. interfere with the servers or network systems of the Service;
4. purchase products in bulk for commercial or resale purposes;
5. act in any other way the Shop judges inappropriate.

Article 9 (Disclaimer)

1. The Shop is not liable for loss suffered by Users due to interruption, suspension or change of the Service.
2. Except in cases of the Shop's wilful misconduct or gross negligence, the Shop's liability for loss suffered by a User in connection with the Service is limited to the price of the products that User purchased.

Article 10 (Changes to these Terms)

The Shop may change these Terms without prior notice to Users where it judges this necessary. The changed Terms take effect when posted on the Shop's website.

Article 11 (Governing law and jurisdiction)

These Terms are governed by and construed under Japanese law. Any dispute concerning the Service shall be subject to the exclusive jurisdiction of the district court or summary court having jurisdiction over the Shop's location (Saitama Prefecture) as the court of first instance.
